These Terms of Service ("Terms") govern access to and use of the services provided by Viper Tools, including but not limited to the following platforms and software products:

Kraken

Megalodon

Vortex

Pegasus

Any related software, tools, APIs, websites, or services (collectively referred to as the “Services”).

By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, you may not use the Services.

1. Eligibility and Account Responsibility

You must be at least 18 years of age to use the Services.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree not to share or transfer access to your account unless explicitly authorized by Viper Tools.

2. Authorized Use of the Services

The Services must only be accessed and used through the official interfaces, dashboards, and tools provided by Viper Tools.

You may not access or interact with the Services in any unauthorized manner.

- Unauthorized access methods include, but are not limited to:

Intercepting internal API requests

Extracting authentication tokens or session credentials

Manipulating platform network traffic

Reverse engineering software behavior

Using browser automation to manipulate backend systems

Sending direct requests to backend endpoints outside the intended interface

Bypassing usage controls or security protections

Any attempt to access internal infrastructure, backend systems, or platform data outside authorized methods constitutes unauthorized system access.

Such activity may result in immediate account suspension, termination, and possible legal action.

3. Anti-Scraping, Automation, and System Manipulation

To protect the integrity of the Services and the security of all users, the following activities are strictly prohibited unless explicitly authorized in writing by Viper Tools:

Scraping or harvesting data from the Services

Using bots, crawlers, or automated scripts to interact with the platform

Browser automation tools designed to intercept platform network activity

Attempting to extract internal API endpoints or backend data structures

Attempting to replicate or reverse engineer platform workflows

Attempting to access, list, modify, or delete data belonging to other users

Performing actions intended to stress test, disrupt, or interfere with system operation

Any use of tools such as Playwright, Selenium, headless browsers, automated AI agents, or similar technologies to intercept internal platform communications or manipulate backend systems is strictly prohibited.

Violation of this section may result in:

Immediate suspension or termination of your account

Revocation of access to all Services

Legal action where appropriate.

4. Platform Security and System Integrity

Users may not attempt to:

Circumvent platform safeguards

Exploit vulnerabilities

Manipulate system behavior

Access restricted system components

Interfere with other user accounts or data

If a user discovers a potential security vulnerability, they must report it to [email protected] and must not exploit the vulnerability or attempt to access data belonging to other users.

5. Artificial Intelligence and Automated Content Tools

Certain Viper Tools Services use artificial intelligence or automated systems to generate outputs, insights, or recommendations.

Users acknowledge and agree that:

AI-generated outputs may contain inaccuracies or incomplete information

AI-generated outputs are provided for informational purposes only

Users are responsible for reviewing and verifying AI-generated outputs before relying on them

Viper Tools makes no guarantees regarding:

Accuracy

Reliability

Suitability

Performance of AI-generated outputs

Users remain fully responsible for any actions taken based on AI-generated information.

6. Subscription Payments and No Refund Policy

All purchases, subscription payments, and service fees are final and non-refundable.

Because access to the Services provides immediate access to proprietary software, tools, and digital systems, refunds will not be issued once access has been granted.

Users are responsible for evaluating the suitability of the Services before purchasing access.

7. Chargebacks and Payment Disputes

By purchasing access to the Services, you agree not to initiate a chargeback or payment dispute without first contacting support.

If a chargeback is initiated without attempting to resolve the matter with Viper Tools:

Your account will be immediately suspended

Your access to all Services will be permanently revoked

You may be permanently banned from future use of the Services

Viper Tools reserves the right to submit evidence to payment processors demonstrating:

Acceptance of these Terms

Platform access logs

Usage history

Service delivery records

Users who initiate fraudulent chargebacks may be responsible for:

Chargeback fees

Administrative recovery costs

Legal expenses associated with recovering disputed funds.

8. Account Suspension and Termination

Viper Tools reserves the right to suspend or terminate accounts at any time if a user:

Violates these Terms

Attempts unauthorized system access

Engages in system manipulation

Causes harm or risk to the platform or other users

Initiates fraudulent payment disputes

Suspension may occur immediately during investigation of suspicious activity.

9. Intellectual Property

All Services, software systems, algorithms, databases, workflows, designs, and proprietary technology used by Viper Tools are protected by intellectual property laws.

Users may not:

Reproduce

Reverse engineer

Modify

Distribute

Replicate

any part of the Services without written authorization.

Unauthorized use of proprietary technology may result in legal action.

10. Service Availability

Viper Tools makes reasonable efforts to maintain uptime and service availability.

However, the Services may experience interruptions due to:

Infrastructure issues

Third-party service disruptions

Viper Tools does not guarantee uninterrupted or error-free operation of the Services.

11. Limitation of Liability (SaaS Liability Shield)

To the fullest extent permitted by law, Viper Tools and its owners, employees, affiliates, partners, and service providers shall not be liable for any:

Loss of profits

Loss of revenue

Loss of business opportunities

Loss of data

Business interruption

Indirect, incidental, or consequential damages

arising out of or related to the use of the Services.

In no event shall the total liability of Viper Tools exceed the total amount paid by the user for Services during the previous 30 days prior to the event giving rise to the claim.

12. Indemnification

Users agree to indemnify, defend, and hold harmless Viper Tools and its affiliates from any claims, damages, losses, or legal expenses arising from:

Misuse of the Services

Violation of these Terms

Unauthorized system access performed by the user

Actions taken based on AI-generated outputs.

13. Modifications to the Services

Viper Tools reserves the right to modify, suspend, or discontinue any portion of the Services at any time.

Features, tools, and pricing may change without notice.

14. Changes to These Terms

Viper Tools may update these Terms periodically.

Continued use of the Services after updates constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by the laws of the United States and the applicable state jurisdiction where Viper Tools operates.
